1. Scope
This Privacy Policy explains how MagiMoments collects, uses, stores, shares, and protects personal information when you use our website, app, products, and services. MagiMoments is offered from and directed to users in the United States.
2. Information We Collect
We may collect:
- Account information, such as your name, email address, login credentials, and account preferences;
- Transaction and order information, such as purchases, order history, billing-related metadata, and fulfillment information;
- Content you submit, such as uploaded photos, prompts, titles, story details, personalization choices, and support communications;
- Generated content, such as personalized stories, illustrated pages, covers, books, and related outputs;
- Device, log, and usage information, such as browser type, IP address, pages viewed, timestamps, referral URLs, and diagnostic data; and
- Information from vendors and service providers, such as payment confirmation or fulfillment status.
3. How We Process Uploaded Photos
When you upload a photo to create personalized content, we process that image to generate the requested output.
We do not retain the original uploaded photo after processing is complete, except as reasonably necessary for short-term technical processing, caching, security, fraud prevention, customer support, debugging, backup, legal compliance, or enforcement.
4. What We Store in Your Account
We may store the generated books, illustrated pages, covers, text, and related outputs created for your account so that you can access, manage, re-download, reorder, or delete them later.
5. How We Use Information
We may use personal information to:
- Provide, operate, maintain, and secure the service;
- Generate personalized books and related outputs you request;
- Process payments and fulfill orders;
- Provide customer support;
- Detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
- Monitor, debug, and improve the reliability and performance of the service; and
- Comply with legal obligations and enforce our Terms.
For clarity, our use of information to "improve the service" does not include using original uploaded family photos or Generated Outputs stored in your account to train general-purpose AI models.
6. Cookies, Analytics, and Similar Technologies
We and our service providers use cookies, web beacons, software development kits (SDKs), and similar technologies to operate the service, remember your preferences, maintain your session, measure usage, diagnose problems, and understand how users interact with the service.
We use third-party analytics providers to help us understand service performance and user engagement. These providers may collect information such as your IP address, device identifiers, browser type, pages viewed, and interactions with the service. This information is used to generate aggregate analytics and improve the service.
You can control cookies through your browser settings and, where available, through in-product controls or a cookie preferences tool. Blocking certain cookies may affect the functionality of the service.
7. Children's Information and Parental Authority
MagiMoments is intended for use by adults, not children. The service is not directed to children, and children should not use the service directly.
If you submit a photo or information relating to a child, you represent that you are the child's parent or legal guardian, or otherwise have the authority to provide that content and authorize our processing of it for the purpose of creating the requested personalized content.
If we learn that personal information relating to a child has been collected or retained in a manner inconsistent with applicable law, we will take appropriate steps to investigate and, where appropriate, delete or remediate the information.
8. AI Model Use
We do NOT use original uploaded family photos or Generated Outputs stored in your account to train general-purpose AI models.
We use third-party AI service providers to generate personalized content on your behalf. These providers' applicable terms generally provide that data submitted through their enterprise or API services is not used to train their models by default, and we configure and use these providers in a manner consistent with those terms and intended to limit use of your content to providing the requested service. These providers may retain content for a limited period for abuse monitoring, security, and legal compliance purposes in accordance with their policies.
9. Sharing of Information
We may share information with service providers and vendors that help us operate the service, including providers of hosting, cloud storage, payment processing, order fulfillment, customer support, security, analytics, moderation, printing, and AI processing.
We may also disclose information:
- To comply with law, legal process, or government request;
- To enforce our Terms or protect the rights, safety, and property of MagiMoments, users, or others;
- In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets; or
- With your direction or consent.
10. Retention
We retain generated outputs stored in your account until you delete them, your account is closed, or they are otherwise removed under our retention practices.
We may retain limited information longer where reasonably necessary for backups, legal compliance, dispute resolution, fraud prevention, security, tax and accounting obligations, or enforcement. When information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it.
11. Your Choices
You may be able to access, manage, or delete generated books and account information through in-product controls. You may also contact us to request deletion or account closure.
We may need to verify your identity before acting on a request.
12. California and Other State Privacy Rights
If you are a resident of California or another U.S. state with applicable privacy rights, you may have rights to know, access, delete, correct, and in some cases opt out of certain uses or disclosures of personal information, subject to exceptions and applicability thresholds.
To exercise these rights, please contact us at privacy@magimoments.com. We will respond to verifiable consumer requests within the timeframes required by applicable law. We may need to verify your identity before acting on a request, and you may designate an authorized agent to submit a request on your behalf, subject to applicable verification requirements.
We will not discriminate against you for exercising any of your privacy rights.
13. Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The updated version will be posted with a revised effective date.
